Tom Morris, attorney for Holiday Island, Arkansas, addressed FOI procedures with the BOC of Holiday Island in January 2010. He provided the BOC with the FOI handbook.

During his discussion and question period, he informed the BOC and the audience that the rules of the FOIA were not intended to curtail those governed by these rules from participating in social events.

This legal interpretation made it possible for two or more commissioners to attend the same social event and not be in violation of the FOI, which carries heavy fines including misdemeanor charges.

At the coffee session held on March 1, at the Recreational Center, there was a need to clarify this legal interpretation further when two commissioners came to the morning coffee with Kevin.

Clarification: Two commissioners can not attend an event together that discusses past, present and potential future business.

Assessor Contract Exceeds HISID Budget

The Holiday Island Suburban District board of commissioners approved a contract on February 28, 2011, to hire Tom Reed & Associates of Fayetteville to complete a Summary Appraisal Report by August 31, 2011.

The line item budgeted amount was for $25,000 and the final contract is for $63,650.

The contract includes "the time involved with all necessary public hearings after completion of the District Reassessment of Benefits Study."

The fee does not include "court preparation or testimony should they be required. Court preparation is invoiced at $150 per hour and court testimony at $175 per hour. The minimum fee for court testimony is $700." [ Assessor pdf ]

Arkansas Attorney General Ruling

The Holiday Island Suburban Improvement District board of commissioners held a regular meeting session on February 28, at the district office. All commissioners were present and the meeting was called to order promptly at 9 a.m.

Property owner Gary Hanson inquired if a ruling had been handed down from the Arkansas Attorney General regarding the collection of franchise fees?

This ruling was received by the district and the AG ruled against the collection of franchise taxes on the service utilities.

This ruling now leaves the Holiday Island Suburban Improvement District's 2011 budget down, which is the result of building a budget with an $85,000 franchise line item under income.

In the State of Arkansas, it is illegal to run a negative budget.

The district manager's report included a concern for the sewer debt. There is a diminishing level of collection on the assessment base for lots. The assessment base was utilized to create the bonds that were issued for building the new sewer plant.

"When the bonds were issued a financial criteria was presented and that criteria has changed," said Hanson.

"Have the bond holders been notified?," he asked.

The board was also asked directly during public comments, IF the board feels the district is in financial trouble?

Chairman Larson answered for the board stating, "The board does think we have financial problems."

Table Rock Landing (TRL) asked for a reassessment of benefits, which was last conducted in 1993.

The board approved District Manager Kevin Crosson to contract with Thomas E. Reed of Reed & Associates Inc., of Fayetteville, Arkansas [pdf] to conduct a scope of work with a line item budget of $25,000.

Reed anticipates completing the re-assessment by August 2011, in time for the board to start discussion on the 2012 budget.

The board approved a non-severable two- year extension on a contract for service with the Carroll County Sheriff's department for just over $90,000 per year.

The officer's contract stipulates that the district provides fuel, uniforms and wages for two full-time officers who will work 40 hours per week each.

If the officers live on Holiday Island, they can are eligible under the negotiations to apply directly to the district for a housing allowance of $250 per month. There are guidelines that each officer must meet in order to receive this housing allowance.

The next regular HISID board meeting is scheduled for March 28, 2011 at 9 a.m.
